Section 40-6-241.1 (the Code) states in pertinent part that, “No person…that has a class C license shall operate a motor vehicle on any road or highway of this state while using a wireless telecommunication device to write send or read any text based communication included, but not limited to, a text message, instant message, e-mail or internet data.”

A Wireless Telecommunication Device is defined as a cellular phone, a text messaging device, a personal digital assistant, a stand alone computer, or any other substantially similar wireless device that is used to initiate or receive a wireless communication with another person. 69% of drivers in the United States ages 18-64 had indicated in a survey that they had talked on their cell phones while driving in the past 30 days according to the Center of Disease Control (CDC).
