$ 14 million is awarded to a woman who suffered permanent injuries after taking the drug Yasmin

picture-for-blog-post-april-26-2014.jpgA jury has awarded $14 million to a woman who sued her doctor after a stroke she suffered after taking the birth control drug Yasmin. It was reported that she had a stroke that paralyzed her left side and caused permanent brain injury 13 days after taking Yazmin. Similarly, a $2.5 million settlement in the same matter was reached with the Medical Center.

The maker of the drug, Bayer, has also been faced with lawsuits from other women who claim that the contraceptive has caused blood clots that have led to serious health conditions. Nevertheless, the company claims that the drug is safe if used as directed.

These cases can fall under two legal categories: 1.) Medical Malpractice; and 2.) Product Liability. To stay abreast of what drugs and other products are being recalled you can visit the U.S. Consumer Protection Safety Commission and http://www.recalls.gov, and you can be added to the emailing list for both of these agencies to receive up to date information about product recalls.

Other drugs that have been recently recalled due to serious complications and even death include, but are not limited to:

1.) DuPuy metal on metal hip replacements;

2.) Transvaginal Mesh;

3.) Fosamax;

4.) Darvon;

5.) Actos; and

6.) Zoloft

We post recalls frequently on our google plus location so feel free to become part of our circle so that you receive this information. We want to be sure that you are aware of any products that have been recalled that could be dangerous or cause injury to you or a loved one.

We have also discussed product liability associated with energy drinks that are commonly enjoyed by many people, and remember that if you are injured for any reason it is important in Georgia to act quickly.

We often wonder why this happens when the Federal Food and Drug Administration (FDA) has approved these drugs. It happens many times since the manufacturer is in too much of a hurry to put the drug on the market that it is not adequately tested, or not tested on enough people; the group of people that are used to test the drug are too small.

Patients have also been injured by errors on the part of the pharmacist who is filling the prescription. For example, if the pharmacist makes a mistake when filling a prescription, then the patient may have a bad reaction to the drug resulting in the patient failing to improve or even worsening a condition.

This type of legal claim would most likely fall under Medical Malpractice rather than Product Liability since the drug is not necessarily defective, but the pharmacist breached the standard of care when dispensing the drug to the patient, and this failure to follow the proper standard of care, rather than the drug itself, is why the patient is seriously injured or dies.
