Proving Liability in Nursing Home Negligence Cases

To prove liability in an action against a nursing home, you will need to prove the nursing home owed a duty of care to the plaintiff, that it breached that duty of care, that the breach of duty caused harm or injury to the plaintiff, and the plaintiff suffered actual harm or damages as a result of the nursing home’s negligence.

A nursing home owes a duty of care to its residents. This duty includes providing a safe and secure environment, adequate supervision, and proper medical care.
