A Woman who was Injured in a Low-Impact Rear End Collision for which she sought Back Surgery was awarded Nothing by a Jackson County, Georgia Jury

t9.jpgIn November, 2001, on a rainy day, the Plaintiff, a woman from Tifton, Georgia named Melissa Chapman, was stopped on Pleasant Hill Road at a traffic light in Gwinnett County, Georgia when she was was hit in the rear of her car by Defendant Ameda Wittmer. Defendant Wittmer would admit to being the cause of the accident, but deny that the accident was the cause of the surgical treatment that the Plaintiff later endured to her back.

The Georgia Supreme Court has ruled that in Medical Malpractice Cases in Georgia that if the Plaintiff’s Affidavit attached to the Plaintiff’s Complaint is Challenged that the Plaintiff May File an Amended Complaint with an Affidavit from a New Expert

t10.jpgThis is a case that many with the Georgia Bar have been watching as the Georgia Supreme Court has ruled unanimously to affirm the Georgia Court of Appeals’ ruling that states that if the Plaintiff’s Medical Expert Affidavit filed with the Plaintiff’s original complaint in a Medical Malpractice Case is found defective, and the Defendant files a Motion to Dismiss the Complaint based on said defect, that the Plaintiff could, if filed within thirty (30) days of being served with said Motion, cure the defect by filing an Amended Complaint with an Affidavit of a new Expert. This ruling serves to further define a rule of law in Georgia that has been in place since the 1980’s as well as set new standards for both Plaintiffs and Defendants in Medical Malpractice Cases in Georgia.

A Federal Jury Awards the Plaintiff $ 3.8 Million in Compensatory Damages for a Tractor-Trailer Collision in Newton County, Georgia

sunset-run-1427546-m.jpgAt 11:00 a.m. on a clear day under dry and level road conditions on I-20 in Georgia, a tractor-trailer driven by Billy Ray Outlaw going 60-65 miles per hour slammed into another tractor-trailer driven by Allen Pace, a former war veteran. The impact, the equivalent of more than 4 million lbs. of force, was so hard that it caused the container that was on Pace’s rig to tip over on its side, it broke the 5th wheel of said rig, and it knocked the rig almost 300 ft. down the roadway causing the entire rig and its contents to be completely destroyed, and causing permanent physical injuries to Allen Pace.

The Jury in a Tractor-Trailer Logging Truck Case in Washington County, Georgia Awards $ 16.5 Million to the Plaintiffs

logging-in-bc-745925-m.jpgJust before 6:00 p.m. in November, 2011, Attorney Albert “Buddy” Dallas was traveling South on Georgia Highway 171 when the lane in which he was traveling was blocked by a logging truck owned by Bass Logging, Inc. and driven by Bennie Dixon. Unable to stop , Mr. Dallas’ pickup truck crashed into the logging truck causing Mr. Dallas to suffer broken vertebrae in his neck and back, and his shoulders were disconnected from his collarbone.

In Fulton County, Atlanta, Georgia a Jury awards $1.5 Million for Injuries sustained by a 7 Year Old Child from a Driver that was Texting and Driving ~ part two

lit-up-mobile-phone-01-103994-m.jpgThis blog post will continue my discussion of a Motor Vehicle Accident case in Atlanta, Georgia that I began discussing in my blog post titled, “In Fulton County, Atlanta, Georgia a Jury awards $1.5 Million for Injuries sustained by a 7 Year Old Child from a Driver that was Texting and Driving ~ part one.” Ms. Anderson, Chasity’s mother who was driving at the time of the accident when she was reared ended by the driver that was texting and driving, was also injured in the accident but settled her injury claim, filed a lawsuit on behalf of her daughter in Fulton County State Court in the year of 2009. The case is Anderson v. Brenner, No. 2009EV007726.

A Gwinnett County, Georgia Multi-Million Dollar Verdict Award Issued to Construction Workers Injured in a Crash Sends a Message Deeper Than Just Dollars ~ part one

urban-accident-27210-m.jpgThis will be my first blog post about this case titled, “A Gwinnett County, Georgia Multi-Million Dollar Verdict Award Issued to Construction Workers Injured in a Crash Sends a Message Deeper Than Just Dollars ~ part one.” In 2010, at the Intersection of South Puckett Road and Hamilton Mill Road in Gwinnett County, Georgia, there was a Motor Vehicle Crash involving an Engineer who was driving a vehicle owned by Georgia Power, Ms. Cassandra Kim Taylor, and a vehicle operated and occupied by Ms. Sandra Flores Juarez and Mr. William Villacorta. Ms. Juarez and Mr. Villacorta are two (2) native El Salvadorians who were working in tandem on remodeling and painting jobs and who both spoke very little English. The issues at trial were negligence, damages, and the potential dangers of bias and discrimination in the judicial process.
